Agreement to Terms

By accessing or using the Philly People of Hope website ("the Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site. We reserve the right to modify these Terms at any time, and your continued use of the Site constitutes acceptance of any changes.

Use of the Site

Permitted Use

You may use the Site for lawful purposes only. You agree not to use the Site:

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent, except as follows:

User-Generated Content

Donations

All donations made through the Site are voluntary and non-refundable unless required by law. Philly People of Hope will use donations to support our mission of community advocacy and support for the unhoused and marginalized in Philadelphia.

We will provide tax receipts for donations as required by law. Please consult with a tax professional regarding the deductibility of your donation.

Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by Philly People of Hope. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Philly People of Hope shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. PHILLY PEOPLE OF HOPE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Indemnification

You agree to defend, indemnify, and hold harmless Philly People of Hope and its licensors, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Philadelphia County, Pennsylvania.

Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The failure of us to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Entire Agreement

These Terms constitute the entire agreement between you and Philly People of Hope regarding the use of the Site and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.
